what I supposed to do regarding a legal action against me?
I just got a file claim from Victorian Civil and Administrative Tribunal and it said one of my buyer lodged that application just because I didn't want to sell a $100 DRESS to her. I have refunded her money twice and explained politely. I got a warning from ebay as well and a negative feedback from her. This application is due on October 7th, 2008 which is 7 days from now. I honestly don't know what to do about it. I admitted I have disobey the ebay rules and got warning from them but I don't expect this buyer to do such action as I didn't take any single cent of her money. She also tried to blackmail me by emailed my other buyer "this seller will not honour sales". I personally believed she just want my money as she wrote $1000 claim for "replacement of the dress and cost". Can anyone here know how to deal with this matter? Thank you
Eric - eBay Australia doesn't allow you to put a reserve price.
When an auction ends on eBay, you and the winning bidder have a concluded contract - you simply cannot choose not to sell her the dress. The courts WILL enforce this contract (contrary to what Eric tells you) - see Smythe v Thomas at http://www.austlii.edu.au/cgi-bin/sinodisp/au/cases/nsw/NSWSC/2007/844.html So, unless you can come up with some damn good story, you will have to hand over the dress. If you don't have it anymore, you will have to pay damages, and her legal costs.
She's not blackmailing you by warning other buyers or leaving you negative feedback - I would have as well. Read the rules of eBay before you use the site.
If you go to the Tribunal, you may end up having to either hand over the dress and pay her legal costs, or pay her what an equivalent dress would cost, plus her legals (which is obviously why she has claimed the $1000). The only way you can get out of it cheaper is if you contact her or her lawyers directly and ask what lower amount it would take to settle the matter.
ps - the rest of Eric's advice is simply nonsense and has no basis in law - her 'damage' if you want to call it that, is that you did not live up to your side of a concluded contract - do a search on "specific performance" in relation to contracts and you will see that the Court will order you to hand over the dress in a heartbeat!

The Physician and Sexuality in Victorian America $20.03 In post-Civil War America, Victorian men and women turned to physicians for scientifically based impartial advice on personal and moral questions as well as for health matters. Doctors played willing advisors to trusting patients. Making their consultation rooms authoritarian settings, they presumptuously doled out personal advice on all topics--from intrafamily communication to proper clothing, exercise, contraception, infidelity, masturbation, and venereal disease. More than any other professional group, doctors expressed the moral judgment of the middle class and articulated the forces that lay in wait for those of both sexes who squandered their birthrights through unrestrained indulgences. Insecure both socially and economically, the rising middle class gave physicians far more authority than their medical and scientific knowledge warranted. Although the middle class operated on a double standard, Victorian men faced enormous expectations and restrictions similar to the proscriptive role assigned Victorian women. John S. Haller, Jr., and Robin M. Haller cover the resulting nervous ailments common to Victorians, in addition to marriage and sexual relationships, proper hygiene, prostitution, and drug addiction. In one of the few sexual studies to deal with both genders, the authors reject the stereotypical view of Victorian sexuality. Discounting the popular dictum of the Victorian period as an aberration in the ascent of women to greater sexual freedom, they posit prudery as a mask behind which women sometimes gained greater freedom of person. |

Sexual Misbehavior in the Civil War $20.02 Over three million young men left home, shouldered rifles, and set about killing one another in the 1860s. Behind, they left wives and sweethearts. The 50,000 books about the war have told us in meticulous detail about the strategy, tactics, weapons, uniforms, canteens, famous generals, religious beliefs, personality quirks, fortifications, battles, sieges, gunboats, medical care, and recruiting policies. The causes of the war have been endlessly analyzed. The surviving veterans wrote hundreds of memoirs, sometimes inflating their own heroism and importance. What rarely appears in this literature is any mention of sex, in spite of most soldiers being in their early twenties, a time of manly vigor. The late 19th century brought the ascendancy of Victorian prudishness and hypocrisy. The Comstock laws sent men to prison for mailing contraceptive advice. Just advice Whatever willingness there might have been to reveal wartime hanky-panky evaporated in the tenor of the time and the admiring gaze of the veteran's growing grandchildren. The following scene would be unimaginable: the old veteran sits by the stove in the country store. His long white beard covers his tattered vest. A faded medal graces his chest. On the floor are the shavings from his most recent whittling. A tiny child pipes up: "Tell us about the war, grandpa." "Well, Jimmy, there was this pretty little whore in Memphis." Never happen. Material collected twenty years ago resulted in the author's 1994 book, The Story the Soldiers Wouldn't Tell - Sex in the Civil War, which presented everything that was then known on the subject. There had been no previous book on Civil War sex. Since then, the author and his wife, Beverly, have read over 90,000 court-martials and countless letters and diary entries. What emerges is that sexual activity was far more common and public than our previous research or any memoir had ever revealed. The records come from literally every corner of the country: Key West, Washington Territory, Los Angeles, and Maine. The malfeasants are both officers and enlisted men. The victims range from six-year girls to sixty-year old grandmothers. The soldiers carried with them lewd books and obscene photos. Even more striking is the universality of houses of prostitution. Every village and every city neighborhood has at least one such-and everybody knew it. They knew the addresses of the houses. They knew the names of the madams and the names of many of the "girls." Most of the witnesses for the trials had visited the houses, for the usual reasons. The military police tramped through the houses, looking for deserters. Rape, thought to be rare during the war, was not that rare. An unexpected finding was that Union soldiers, who were supposedly freeing the slaves, were quick to rape black women.
